Terms of Service

These Terms of Service (“Terms”) are a contract between you and FundayFinder (“FundayFinder,” “we,” “us”) governing your use of the FundayFinder website and app (the “Service”). By using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

1. Eligibility

You must be at least 18 years old and a parent, guardian, or caregiver to use the Service. By using it, you represent that you meet these requirements and that the information you provide is accurate.

2. What FundayFinder is (and isn’t)

FundayFinder suggests activities and builds sample plans based on the information you enter, general weather forecasts, and a curated list of places and events. It is an informational planning tool only. We are not affiliated with, and do not operate, inspect, endorse, or guarantee, the venues, events, businesses, or third-party content it references.

3. Safety and your responsibility

Suggestions are not guarantees. You are solely responsible for the safety and supervision of your children and yourself. Always independently verify hours, prices, admission rules, age and height requirements, weather, water conditions, and the suitability and safety of any activity before you go. Use your own judgment — you know your child best. Never leave children unattended, and exercise extra caution around water, animals, heat, and traffic. Details in the app (including hours, costs, and availability) may be inaccurate, incomplete, or out of date.

4. Your account

You sign in with a one-time email link. Keep access to your email secure; you’re responsible for activity under your account. Tell us promptly if you suspect unauthorized use. One account is intended for one person or household.

You may submit reviews, notes, ratings, and spot suggestions (“User Content”). You keep ownership of your User Content, but you grant FundayFinder a worldwide, royalty-free license to host, display, adapt, and distribute it to operate and promote the Service. You represent that your User Content is accurate to your knowledge, is yours to share, and doesn’t violate anyone’s rights.

Community submissions are reviewed before they appear publicly, and we may edit, refuse, or remove any content at our discretion — but we’re not obligated to monitor content and aren’t responsible for what users post.

The Service, including its software, curated data, text, design, and the FundayFinder name and logo, is owned by us or our licensors and protected by law. We grant you a limited, personal, non-transferable license to use the Service for your own family planning. You may not copy, resell, or create derivative products from our content without permission.

9. Third-party services and links

The Service relies on and links to third parties (for example, Stripe, Supabase, Google, weather data, and city event calendars) and may include affiliate links from which we earn a commission at no extra cost to you. We aren’t responsible for third-party services, content, pricing, or availability, and your use of them may be subject to their own terms.

10. Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that suggestions, listings, hours, prices, or events are accurate, current, or suitable, or that the Service will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent permitted by law, FundayFinder and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any injury, loss, or harm arising from your use of the Service, reliance on any suggestion, or your visit to any venue or event. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US $50. Some jurisdictions don’t allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless FundayFinder and its operators from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Termination

You may stop using the Service and delete your data at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. Sections that by their nature should survive (including ownership, disclaimers, and limitation of liability) will survive termination.

14. Changes

We may update the Service and these Terms. For material changes to the Terms we’ll update the “Effective” date and provide reasonable notice. Continued use after changes means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. You agree that the state and federal courts located in Broward County, Florida have exclusive jurisdiction over any dispute not otherwise resolved, subject to any mandatory consumer-protection rights in your place of residence. We encourage you to contact us first so we can try to resolve any issue informally.
